A former teacher's aide in McMinn County has been granted judicial diversion after she admitted having sex with at 16-year-old male student.
Tonia Hennessee Martin acknowledged in McMinn County Criminal Court last month that she had sex with the boy on two occasions.
Martin did not enter a guilty plea, but applied for diversion and a judge granted her request.
A court clerk said if Martin stays out of trouble for two years, she can ask to have her record cleared.
Martin's agreement said that she is to have no contact with the victim, must stay off school grounds, and can not attend any school functions. She is also liable for all court costs.
In February, Martin surrendered after she was indicted on charges of
aggravated statutory rape and solicitation of a minor.
At that time, McMinn County Sheriff Joe Guy said a report showed that Martin was employed as an
elementary school teacher's aide at the time of the sexual contact. He said there was no
evidence that anything happened at a school.
