A man convicted of reckless homicide and child neglect in the death of his 14-month daughter is heading back to jail.
Mitchell DeLashmitt will serve the remaining year and a half of his 5-year probation in prison for violating his parole.
Police originally arrested him in June of 2003, after the body of his 14-month-old daughter, Angel, was discovered in a pond near his home in McMinn County.
Prosecutors charged him with felony murder, child abuse, and rape, but in his 2010 plea agreement, the felony murder charge became a reckless homicide charge.
A McMinn County judge sent DeLashmitt back to jail because he didn't maintain a job and tested positive or meth last year.
