After newly filed information in the Christian-Newsom case, attorneys for Lemaricus Davidson are asking for a new trial due to outside influences on the jury during deliberations.
The motion says the jury held a religious "praise" service while deliberating Davidson's death sentence. It goes on to state that the jury violated Davidson's rights to a fair trial and due process, an impartial jury, and fair, reliable, individualized sentencing.
Post trial documents show one of the jurors had requested a praise service. It also reported that the jury utilized copies of hymns, and one juror led the others in song, while accompanying them with a guitar. A second juror read a Bible verse.
A judge will hear the amended motion at 9 a.m. on January 10.
