Tennessee is sticking with its policy of blocking public access to case files when children under state supervision die.

A coalition of news organizations led by The Tennessean newspaper and the Associated Press are suing the state to release the case records, saying it's in the public's interest.

The inquiry comes after an investigation into the deaths of 31 Tennessee children who were under the supervision of the Department of Children's Services.

DCS Commissioner Kate O'Day is refusing to disclose details due to privacy concerns. She say the rules are meant to protect families, not to shield her agency for criticism.

A hearing is set for Tuesday.
