The store manager who shot and killed an armed robber as he was fleeing will not be charged.

According to John Gill with the Knox County District Attorney General's office, the evidence against Anthony Quinn Smith "would not support a conviction."

In February, Knoxville Police say Justin Pierre Jackson, 30, robbed the Dollar General Store on Asheville Highway.  As he ran through the parking lot with the cash, Smith pursued him and told reporters that he fired several shots at Quinn, who returned fire.  Quinn was shot in the back, and died after crawling into an alley a short distance away.

Jackson was wanted for several armed robberies, which police said were becoming more and more aggressive.
