(WBIR-Anderson County) A mother who is accused of causing injury to her 7-month-old baby while she was fighting with her fiance is set to appear in court Tuesday.

Mellissa Darnell Shillings and her fiance David Lee Francis are facing aggravated child abused and assault charges.

Shillings' baby was kicked in the head while the couple was fighting.

The 35-year-old Shillings was arrested in July.

According to court documents, Shillings hit Francis twice while holding her 7-month-old son. Francis then kicked Shillings in the head, also hitting the infant.

An ambulance took the 7-month old to East Tennesee Children's Hospital. The boy was treated and released that evening from the hospital and is in state custody.
