Attorneys: Some companies who've filed suit actually owe Pilot Flying J money

(WBIR-Knoxville) Pilot Flying J's attorneys are arguing that a handful of companies owe them money in light of the probe into an alleged rebate scheme.

Lawyers from Pilot Flying J met with prosecuting attorneys Tuesday.

Drew McElroy is representing a handful of companies not taking part in a class action settlement against Pilot. He is trying to obtain Pilot's financial documents to learn how much his companies are owed.

However, Pilot's lawyers say those companies may have actually been undercharged or didn't pay enough, so they instead owe Pilot money.

For now, the two sides are trying to reach an agreement on sharing information.

"We want access to the information, we need to decide what we're owed. How far we've got to go and how deep we've got to dig is something we're in the process of finding out," said McElroy.

McElroy says they are making baby steps in progress. Lawyers will try to reach an agreement before next Thursday. If they cannot, a judge will intervene to help settle the dispute.
