Defense attorneys for a former Knox County jailer caught on video kicking a hog-tied inmate will not be able to call a doctor as a witness during trial they hoped to have testify about the jailer's mental state.
A judge ruled during a status hearing Friday that the doctor is not an admissible expert witness.
The ex-correction officer, Nicholas Breeden, goes on trial for official oppression and assault charges next month.
Breeden's attorney cited a "fight or flight instinct" in the incident where Breeden was caught on video kicking a hog-tied inmate, Louis Flack, in the face.
