
A Knoxville man could spend the next 40 years in prison for his involvement in a rock throwing death.
His defense attorney isn't happy about it.
A judge sentenced Matthew Carter to 23 years in prison for the second degree murder of Barbara Weimer back in May of 2004.
Carter did not throw the rock from the overpass that killed Weimer but drove the two men who did.
Carter also faces two other consecutive prison sentences stemming from the incident.
In court on Thursday, Carter apologized to Weimer's family saying he never intended to hurt anyone and that he was sincerely sorry.
Bruce Poston, Carter's Attorney says, "These boys are doing more time than people who have intentionally gone out and killed people, tortured them and then plead out to 25 or 30 years. It amazes me what's going on in this case."
Poston has already requested a motion for a new trial. He plans to file for an appeal if that's rejected.
Alford Morgan is already serving a life sentence.
While Jeremy Kelley still needs to stand trial.
