
In September, Judge Richard Baumgartner ordered Poston to devote more time to defending Letalvis Cobbins who is facing the death penalty.
Cobbins is one of four defendants charged with raping and killing Channon Christian and Chris Newsom.
Judge Baumgartner believes that court order was violated, which led to another attorney being appointed and all four trials being pushed back.
"Mr.Poston you are relieved of further obligation to this case," Judge Baumgartner said Friday morning.
Judge Baumgartner removed Poston and appointed Former Assistant District Attorney General Scott Green as co-counsel to defend Cobbins. Kim Parton is lead counsel for Cobbins' defense.
"I've never seen a case like this I've been involved with several hundred homicide cases, I've never seen anything with the volume of this case," defense attorney Scott Green said.
Green says he will take the court appointment but he will need time to go through thousands of pages of evidence.
Cobbins told the court he was prepared to postpone his trial.
"Yes, sir, I do believe it will be in my best interest to counsel with Mr. Green," Cobbins said.
However the prosecution argued for a speedy trial for Cobbins.
"He has had Ms. Parton from the very beginning and she's been on this for 2 years what's been going on? Have they been preparing this case and can't she get Mr. Green up to speed in time," Assistant District Attorney Leland Price said.
Judge Baumgartner moved Cobbins' trial from January to July 6, 2009. All four trials will be delayed as a result of Poston's removal.
The judge turned his attention to Poston, who he said is a person he considers a friend. However, Judge Baumgartner said he was disappointed with Poston's inability to take the Cobbins case seriously.
"I hope the gravity of this has hit you here," Judge Baumgartner said.
Poston is accused of contempt for not devoting more time to the capital murder case.
Poston has been defending another high profile client since 2007. A jury convicted Eric McLean of reckless homicide for shooting and killing his wife's 18 year old lover, Sean Powell. McLean was sentenced to 47 days in jail on the same day Poston was removed from the Cobbins case.
The defense attorney says he's upset about disappointing Judge Baumgartner and he hopes the judge will hear him out at his contempt hearing on December 12.
"Hopefully he'll find that nothing was intentional I mean everybody knew how busy I was," Poston said.
Meanwhile, Channon Christian and Chris Newsom's family are committed to see the trials through no matter how long it takes.
"We got a lot to do and they keep dragging it out and dragging it out if they think we're going to go away it ain't happening," Channon Christian's father, Gary said.

Judge Baumgartner wanted to remove Poston from the case on Wednesday, but Poston sent his assistant to tell the court a medical issue kept him at home.
Wednesday's delays outraged the family of victim Channon Christian, with Gary and Deena Christian having a heated conversation with prosecutors about the rights of a victim's family.
When the hearing was re-scheduled for Friday on Wednesday, Deena Christian said the delays were forcing her to break a promise she made to her daughter, that she would be in court for every step of this process.
Deena Christian said Wednesday she had a professional obligation that would keep her from attending a Friday hearing. She was not in court Friday.
Poston will face Judge Baumgartner for a contempt hearing on December 12th.
He could be fined and even face jail time.
Cobbins' trial has been pushed back to July 6.
Cobbins' co-defendants were not in court Friday, but they were represented there by their attorneys.
Vanessa Coleman's trial date has been set for August 10.
Lemaricus Davidson's trial date is set for September 21.
George Thomas will go to trial December 2.
