Kodak man trampled by horse appeals judge's decision

An East Tennessee man, who was trampled by a horse five years ago, is appealing a judge's decision to dismiss his lawsuit over the incident.

David Prater, 43, of Kodak said he was waiting in line for the bathroom at a University of Kentucky football game, when a police horse knocked him down before stepping on him.

According to a 2009 report, the university's band spooked the horse. Practer had to undergo multiple surgeries following the incident.

Practer is appealing to reinstate his civil action against the former police officer who was on the horse.
