A Tennessee mother involved in an high-speed chase in New Mexico that was all caught on a dashboard camera will not have her charges dropped.

Video of that incident spread quickly, showing an officer shooting at the fleeing van with five children inside.

Thursday, a New Mexico judge denied a request by the woman's lawyer to dismiss charges based on grand jury proceedings. The judge did say the lawyers could file an appeal before the trial about what they feel were legal issues during grand jury proceedings.

The Memphis woman is charged with aggravated fleeing from an officer and child abuse.

Authorities last month dropped charges against the woman's son, who was seen in the video fighting with officers.
