(POLK COUNTY) A 13-year old girl who was aboard a buggy struck by a van Tuesday has succumbed to injuries she sustained in the crash.

Lt. John Harmon of the Tennessee Highway Patrol confirmed the death Wednesday to WRCB-TV in Chattanooga.

Charges against the driver could be upgraded in light of the death.

THP's report on the van that crashed into the horse-drawn buggy Tuesday indicates the van's driver was drunk.

The THP says that the van's driver, Jason Shelton, 28, was traveling at a high rate of speed on Linsdale Road in Polk County when he struck a horse-drawn buggy that was hauling corn.

The buggy, driven by Daniel Wanner, 50, also carried the 13-year-old passenger. She was airlifted to a local hospital.

Shelton continued to drive the van after the crash for a distance, according to authorities, and then fled on foot. TWRA and deputies were able to capture Shelton, and they say they found him to be intoxicated.

Charges against Shelton include: No proof of insurance; leaving the scene of a crash with injuries; leaving the scene of a crash; DUI; vehicle assault by intoxication; failure to render aid; and following improperly.
