Lawsuit: 2 teachers conspired so 1 could have sex with student

A former Knox County middle school teacher had sex with a 14-year-old student multiple times, at least one of which occurred with the knowledge and cooperation of a former coach and teacher, a Knox County Circuit Court lawsuit alleges.

The unnamed mother of the boy filed suit Monday against Serena Rae Milan, Sean Green, Knox County and the Knox County Board of Education.

The mother is seeking several million dollars in damages against the defendants on behalf of her son.

Milan, 29, already faces indictment in Knox County Criminal Court on counts of statutory rape by an authority figure, solicitation of a minor, especially aggravated sexual exploitation of a minor and sexual activity involving a minor, according to records.

She is due in Criminal Court on Thursday morning, according to records. A grand jury indicted her in November.

Green has not been charged.

According to the lawsuit, Green formerly taught at Maynard Elementary School "and due to inappropriate conduct was transferred to Northwest Middle School."

Knox County Schools spokeswoman Melissa Tindell said Monday: "As a general practice, we do not discuss matters of pending or active litigation."

The lawsuit filed by Eddie Daniel alleges the woman began having sex with the Northwest Middle School student in the spring of 2015.

According to the indictment, Milan had sex with the boy between February and July 2015. The English Language Arts (ELA) Intervention teacher resigned in July 2015.

According to the document, Green took the boy to Milan's class at school, allegedly to help him learn to work with computers and get other educational assistance. After Green handed off the boy, Milan locked the classroom door and had the teen sit at a computer, according to the lawsuit.

The complaint states she began touching him inappropriately and then "performed sexual acts" on him in the room.

Green was friends with Milan and knew what she planned, according to the lawsuit. Green "entered into a conspiracy" with Milan to make sure no one found out she was having sex with the teen, according to the lawsuit. He failed to alert education officials about what was happening, according to the lawsuit.

The lawsuit alleges Milan sent the boy sexually explicit pictures. She also arranged to meet him at West Town Mall and then took him in a vehicle to a secluded area so she could perform sex acts on him, the complaint states.

The boy's mother alleges the school board failed to provide a safe environment that would have protected the boy from the sexual contact.

The lawsuit alleges "there have been persistent incidents of sexual abuse of students by Knox County Board of Education employees in the past." It does not identify specifics.
